The Supreme Court has upheld the cassation appeals from a number of creditors of "Eldorado" (LLC "Diessa") and has decided to reject the approval of the company's recovery plan.
As indicated in the registry of judicial decisions, the corresponding ruling was approved by the court on November 26.
Thus, the cassations from the Central Interregional Department of the State Tax Service for working with large taxpayers, LLC "Sellbuy", LLC "Ididji Group", LLC "Group Seb Ukraine", and LLC "Delonti Ukraine" were fully satisfied, while LLC "SVP Plus" was partially satisfied.
Additionally, the previously adopted decisions of the courts of first and appellate instances, which approved the recovery plan for "Diessa", have been revoked, as noted in the document.
As reported, the Economic Court of Kyiv approved the pre-trial recovery plan for "Eldorado" in April 2024, which guarantees the return of 30% of creditor claims, another 40% after compensation for damages from the aggressor state, and a write-off of 30%.
During the general meeting on September 22, 2023, creditors of "Eldorado", holding over 60% of the total debt claims, approved the debt recovery plan exceeding 1 billion UAH. However, several creditors expressed disagreement with the pre-trial recovery and demanded recovery within the bankruptcy procedure, which guarantees debt repayment.
In May 2024, LLC "Diessa" began fulfilling its obligations under the recovery plan.
The first "Eldorado" store in Ukraine was opened in 1999 in Kyiv. As of August 2023, the Eldorado.ua network had 70 stores across 49 cities.
LLC "Diessa" was established in 2009 with a charter capital of 70,000 UAH. According to the Unified State Register of Legal Entities and Individual Entrepreneurs, the owner is LLC "Potnef Enterprises Limited" (100%), with the ultimate beneficiary named as Kristalla Alexandrou Papa (Cyprus).
